Course Description:

This course examines the rules and criteria of NAFTA, and preparation of the NAFTA Certificate of Origin. It is an intermediate-level course that also explores free trade agreements in general and other special arrangements, but focuses on those of the United States and specifically on NAFTA  Exposure to the U.S.-Chile FTA, the U.S.-Israel FTA, and the Generalized System of Preferences are included. Annex 401 (HTUSA General Note 12) is explored in detail.

Prerequisite: None.  Workplace experience with the HTSUSA preferred.

Course Credit: 3 Credit Hours

Major Course Topics & Course Outcomes

As a result of the group and individual activities included in this course, the student will acquire the following knowledge and skills that can be applied to the workplace:

Introduction to Foreign Trade Agreements

  • Define and judge the advantages of a Free Trade Agreement.
  • Identify and interpret the concept of coverage of articles under an FTA.
  • Differentiate among Free Trade Agreements globally.

Introduction to NAFTA

  • Differentiate among NAFTA qualifying and nonqualifying.

Introduction to the NAFTA Certificate of Origin

  • Identify prima facie validity of a NAFTA Certificate of Origin.
  • Be able to properly create a NAFTA Certificate of Origin for qualifying goods.
  • Recognize the uses of a NAFTA Certificate of Origin domestically, and with exports and imports.
  • Differentiate the treatment of non-NAFTA qualifying goods.
  • Differentiate among and determine the possible penalties of a false NAFTA certification.
  • Recognize the use of the Verification of Origin Questionnaire and the need for compliance.

The Preference Criteria

  • Understand the difference between the NAFTA Preference Criteria and the NAFTA Rules of Origin.

The Rules of Origin

  • Understand and be able to apply the NAFTA rules of origin in accordance with the Preference Criteria.
  • Correctly utilize the NAFTA preference criteria to determine NAFTA or non-NAFTA status.
  • Identify and justify NAFTA under the correct preference criterion as applicable.
  • Properly utilize Annex 401 in the use of Preference Criterion B.
  • Determine Regional Value Content as required

Qualifying under Preference Criterion D

  • Determine the circumstances under which Preference Criterion D can be utilized.
  • Properly utilize Preference Criterion D for NAFTA qualification when applicable.

Understanding NAFTA Preference Criteria as the "Big Picture"

  • Utilize NAFTA Preference Criteria correctly and in sequence.
  • Anticipate possible misunderstandings of NAFTA Preference Criteria, judge correct application of the Criteria, draw proper conclusions and defend them.

Other Special Trade Provisions

  • Examine and understand the basic requirements of the Generalized System of Preferences for the United States.      
  • Be able to locate and implement the exception provisions for special trade provisions.

Other Free Trade Agreements

  • Examine and understand the basic requirements of the U.S.-Israel Free Trade Agreement.
  • Distinguish among the types of basic requirements of free trade agreements and special trade provisions to which the U.S. is a party.
